Purpose

This agreement addresses restoration of landscaping, vegetation, screening, and privacy conditions after tree cutting or landscaping work caused removal or alteration of trees, shrubs, brush, or vegetation.

Privacy Restoration Standard

The restoration objective is to substantially recreate the previous visual privacy conditions and block newly exposed views.

Requirements:

  • Continuous visual barrier
  • Block direct sightlines toward residence
  • Sufficient density and spacing
  • Cover all newly exposed viewing angles
  • Evergreen or year-round privacy species where appropriate

Site Restoration

  • Remove debris and damaged material
  • Restore disturbed grading and soil
  • Replace ground cover
  • Repair incidental property damage

Maintenance Responsibilities

Contractor shall maintain watering, stabilization, replacement, fertilization, and establishment care formonths after installation.

Plant Survival Warranty

Warranty period: months (recommended: 12–24 months).

Any dead, diseased, damaged, or failed vegetation shall be replaced at contractor expense.

Failure to Perform

If contractor fails to cure deficiencies withindays of written notice, owner may hire another contractor and recover reasonable costs.

Attorney Fees / Dispute Resolution

If legal action becomes necessary, prevailing party may recover reasonable attorney fees and costs. Parties agree to attempt mediation before litigation unless emergency relief is necessary.

Entire Agreement

Changes must be made in writing and signed by both parties.

Governing Law

This Agreement is governed by Oregon law.
